Dear Atty. Pulido:
Hi, I hope you can help me.
Early last year, January 5 to be exact my husband left me and my
two kids to live with another woman. I haven't made any legal action
against them even as he has been remissed in sending monthly financial
support. I would like to know if there is a time limit in which
I can file a complaint. Right now I can't afford the services of
a lawyer. If i file now, will the courts honor my complaint considering
the time that has lapsed since my husband left. Please, I hope you
can help me.
Missy
Atty. Jeanie S. Pulido's Reply:
Dear Missy,
Prescription would be the least of your worry in your planned complaint
for support to your kid against your husband. The only disadvantage
of the delay in filing an action for support is that there is a
chance that the court would no longer award back support to you
especially if your husband will not be in a position to pay back
support.
Hope I answered your question.
